Both the federal and state governments have laws governing adolescent health privacy and safety in schools. Health Insurance Portability and Accountability Act – HIPAA – establishes federal standards that protect the patient information of healthcare providers and others. HIPAA requires that schools have in place policies and procedures to protect student health data from unauthorised access, disclosure, use or usage.
State laws may protect the safety of adolescents and their health in school settings. Some states have mandated comprehensive health education programs that include HIV/AIDS education; other states demand schools provide medical services, such as immunizations. Several states also prohibit discrimination based upon gender identity or sexuality.
It is important for parents, guardians, teachers, administrators, counselors and other stakeholders to understand these laws so they can ensure all adolescents are provided with safe learning environments where their rights—including their right to privacy—are respected and protected.
